Something that breaks the first time it is used clearly has a manufacturing defect and if the product is still in warranty it should be covered. It should be clear on inspection that the item isn't worn out but broken and hasn't been used very much and it should be possible to find someone there with the sense to recognise the truth of this - but how long is the warranty period? I know many American power tools only have a crazy and unfair 90 day warranty. No warranty covers fair wear and tear so at face value Lowes could justifiably feel they are in the right. ![]() You didn't describe the sander so it is difficult to know the type but generally the backing pad of many designs, such as the random orbit type, the mouse and the triangular type is considered a consumable item and is expected to wear out and need replacing periodically and having bought it in April, had it been in regular use, it could now reasonably be worn out.
